STATEMENT OF WITNESS (C.J.Act,1967 S.9;M.C. Act, 1980, S.102; M.C. Rules, 1981, r.70)

This statement is true to the best of my knowledge and belief and I make it knowing that, if tendered in evidence, I shall be liable to prosecution if I have willfully stated in it anything which I know to be false or do not believe to be true.

REACTIONS TO PROSECUTION EVIDENCE

Statement of Eileen Speak

Ms. Speak claims that I had scruffy hair sticking out all over the place, but makes no mention of the fact that I was wearing a conspicuous top hat. She also does not mention the t-shirt that I was wearing and the words on it.

Ms. Speak claims that I used the word ’Fucking’, a lot. I did not use that word, although I do accept that I used the word “Bollocks” and probably the word “Shit” and “Bastard”.

I note that she describes the distress of her daughter. And on the face of it, it is not clear that she should be giving this evidence rather than the daughter (but I notice that the daughter is disabled and in a wheelchair and that this is not a point I wish my solicitors to take up).

Finally, I note that the statement indicates that Ms. Speak is a POLICE OFFICER. That is probably just a misprint, but it might be worth exploring.

PS Nxxxx The officer has not given a full account of what happened prior to my arrest, and for that, I refer to my separate statement. I agree that my response to caution was words to the effect of those he has recorded, but I also did mention the Human Rights Act - again see my statement.

PS Nxxxx does not make any reference to hearing the word “Fucking” at all.

PS Mxxx I have similar comments to PS Mxxh’s statement as to the other officer but I am reassured that he at least noted that I was wearing a feathered top hat and the “bollocks” t-shirt.

Police Notebook of PC Sxxxxxxx I note that the officer describes the words that I was using with the qualifier “or words to that effect”. And on that basis, I don’t really dispute what he says about what I was saying, but refer to my statement above for more detail about what happened when he and his colleagues approached and arrested me. The most significant thing about his statement is that he appears to accept that I was not given any warning before I was arrested.

He too notes that I was wearing the “Bollocks to Blair” t-shirt, and he also has a more accurate version of my response to the post-arrest caution.

PC Mxxxxx I have no challenge to this officer’s evidence and note that he or she observed that I was compliant and there was no need to handcuff me.

Statement of PC Lxxxxx This is the officer with the machine pistol, who was taking notes about what I was saying, rather than doing her job, and keeping an eye on her own weapon.
